Local audit institutions at various levels shall, under the respective leadership of the governors of provinces, chairmen of autonomous regions, mayors, prefecture heads and heads of counties or districts as well as under the leadership of audit institutions at the next higher levels, exercise supervision through auditing over the budget implementation at the corresponding levels as well as other revenues and expenditures, and submit audit reports to the people's governments at the corresponding levels and to the audit institutions at the next higher levels. &lt;/p&gt; &lt;p&gt;3.The National Audit Office shall exercise supervision through auditing over the revenues and expenditures of the Central bank. Audit institutions shall exercise supervision through auditing over the assets, liabilities, profits and losses of the State-owned monetary organizations. &lt;/p&gt; &lt;p&gt;4.Audit institutions shall exercise supervision through auditing over the revenues and expenditures of the State institutions as well as other public institutions utilizing financial funds.&lt;/p&gt; &lt;p&gt;5.Audit institutions shall exercise supervision through auditing over the assets, liabilities, profits and losses of the State-owned enterprises. &lt;/p&gt; &lt;p&gt;6.Supervision through auditing over the enterprises and monetary organizations with State-owned capital controlling their shares or playing a leading role shall be stipulated by the State Council.&lt;/p&gt; &lt;p&gt;7.Audit institutions shall exercise supervision through auditing over the budget implementation and final accounts of the construction projects fully or primarily financed by government investment.&lt;/p&gt; &lt;p&gt;8.Audit institutions shall exercise supervision through auditing over the revenues and expenditures of the social security funds, public donations and other relevant funds and capital managed by governmental departments and other units authorized by the government.&lt;/p&gt; &lt;p&gt;9.Audit institutions shall exercise supervision through auditing over the revenues and expenditures of projects with aids or loans provided by international organizations or governments of other countries.&lt;/p&gt; &lt;p&gt;10.Audit institutions shall, in accordance with the relevant provisions of the State, supervise through auditing the performance of economic accountabilities held by the responsible persons of state organs and other units subject to auditing as stipulated by law, for one’s term of office and in respect of the revenues, expenditures as well as relevant economic activities of the district, department or organization the auditees belong to.&lt;/p&gt; &lt;p&gt;11.Audit institutions shall exercise supervision through auditing over the items that shall be audited by audit institutions as stipulated by other laws, administrative rules and regulations, in accordance with the provisions of this law as well as relevant laws, administrative rules and regulations. &lt;/p&gt; &lt;p&gt;12.With regard to the particular items relating to State revenues and expenditures, audit institutions shall have the right to carry out special investigations through audit from relevant localities, departments and units and report the results thereof to the people's governments at the corresponding levels and to the audit institutions at the next higher levels. &lt;/p&gt; &lt;p&gt;13.Audit institutions shall determine their audit jurisdiction on the basis of the auditees' financially subordinate relations or the supervisory and managerial relations with respect to the State assets of auditees.&lt;br /&gt;Where a dispute arises on audit jurisdiction between audit institutions, the matter shall be determined by an audit institution superior to both disputing parties. &lt;br /&gt;Audit institutions at higher levels may authorize audit institutions at lower levels to audit the items under their jurisdiction as stipulated from paragraph 2 of Article 18 to Article 25 in this Law. Audit institutions at higher levels may directly audit the major items under the jurisdiction of audit institutions at lower levels. However, unnecessary repetitive audits shall be avoided. &lt;/p&gt; &lt;p&gt;14.Organizations subject to auditing by audit institutions as stipulated by law, shall establish and improve their internal auditing systems in accordance with the relevant provisions of the State; such internal auditing thereof shall be subject to the professional guidance and supervision of audit institutions.&lt;/p&gt; &lt;p&gt;15.If the organizations audited by public audit firms are subject to auditing by audit institutions as stipulated by law, Audit institutions shall, in accordance with provisions of the State Council, have the right to check relevant audit reports produced by public audit firms.&lt;/p&gt; &lt;p&gt;&lt;strong&gt;Powers of Audit Institutions in China&lt;/strong&gt;&lt;/p&gt; &lt;p&gt;According to Audit Law of the People's Republic of China and other related rules and regulations, the powers of audit institutions in China are:&lt;br /&gt;&amp;nbsp;&lt;br /&gt;1. Audit institutions shall have the power to require auditees to provide, in accordance with the request by audit institutions, their budgets or plans for other revenues and expenditures, statements about budget implementation, final accounts and financial reports, electronic data for revenues and expenditures stored and processed by computers and necessary computer technology documents, information about their accounts in monetary organizations, audit reports produced by public audit firms and other information relating to their revenues and expenditures. Auditees shall not refuse to do so, or delay the provision or make false reports.&lt;br /&gt;&amp;nbsp;&lt;br /&gt;The heads of auditees shall be held responsible for the authenticity and integrity of such financial and accounting information provided by them.&lt;br /&gt;&amp;nbsp;&lt;br /&gt;2.Audit institutions shall, in conducting audit, have the power to examine the accounting documents, account books, financial reports, information system used for the management of electronic data for revenues and expenditures, and other information and assets relating to revenues and expenditures of the auditees, and the auditees shall not refuse to produce those materials.&lt;br /&gt;&amp;nbsp;&lt;br /&gt;3.Audit institutions shall, in conducting audit, have the power to carry out investigations among units or individuals concerned into matters relating to audit items and obtain relevant testimonial materials. The units and individuals concerned shall support and assist the audit institutions in their work by providing them with truthful information and relevant testimonial materials. &lt;br /&gt;&amp;nbsp;&lt;br /&gt;Audit institutions, with the approval of the responsible persons of audit institutions of people’s governments at or above the county level, have the power to inquire about the accounts of auditees in monetary organizations.&lt;br /&gt;&amp;nbsp;&lt;br /&gt;Audit institutions, with the proof of auditees’ depositing public funds in personal accounts and approved by the primary responsible persons of audit institutions of perople’s governments at or above the county level, have the power to inquire about the saving deposits of auditees in the name of individuals in monetary organizations.&lt;br /&gt;&amp;nbsp;&lt;br /&gt;4.When audit institutions conduct audit, the auditees shall not transfer, conceal, falsify or destroy their accounting documents, account books, financial reports or other information relating to their revenues and expenditures, and shall not transfer or conceal the assets that are in their possession but obtained in violation of the provisions of the State.&lt;br /&gt;&amp;nbsp;&lt;br /&gt;Audit institutions shall have the power to stop acts of auditees in violation of stipulations specified in the preceding paragraph; If necessary, audit institutions, with the approval of heads of audit institutions at or above the county level, have the power to seal relevant materials and assets obtained in violation of the provisions of the State; If it is necessary to freeze relevant saving deposits of auditees in monetary organizations, audit institutions shall appeal to the People’s court for its adoption.&lt;br /&gt;&amp;nbsp;&lt;br /&gt;Audit institutions shall have the power to stop the ongoing acts of the auditees relating to the revenues and expenditures in violation of the provisions of the State. If they do not succeed in stopping such acts, they shall, with the approval of the responsible persons of audit institutions of people’s governments at or above the county level, notify the departments of public finance and the competent authorities to suspend allocating funds directly related to the acts in violation of the provisions of the State regarding the revenues and expenditures or to suspend the use of the funds already allocated.&lt;br /&gt;&amp;nbsp;&lt;br /&gt;Adoption of the measures specified in the preceding two paragraphs by audit insitutions shall not hinder the lawful business activities, production and operation of the auditees.&lt;br /&gt;&amp;nbsp;&lt;br /&gt;5.If audit institutions consider that the regulations of the competent departments at higher levels on revenues and expenditures implemented by the auditees contravene the law or the administrative rules and regulations, they shall suggest that the competent departments concerned make corrections. To supervise the enforcement of laws, regulations, contracts and statutes by foreign-invested enterprises. To guide and oversee nationwide efforts in attracting foreign investment and other business opportunities, as well as the establishment and trade performance of foreign-invested enterprises in China. Comprehensively guide and coordinate the specific work of state-level economic and technological development zones.&lt;/p&gt; &lt;p&gt;10. To be responsible for China's foreign economic cooperation efforts. To formulate and implement policies and regulations on foreign economic cooperation, guide and monitor the regulation of overseas contract projects, labor cooperation and designing and consulting businesses. To be in charge of China's efforts in providing aid to foreign countries and regions. To formulate and implement China's foreign aid policies and plans, and sign the relevant agreements. To compile and execute annual foreign aid programs. To supervise and inspect the implementation of China's foreign aid projects. To manage China's foreign aid fund, concessional loans, special funds and other foreign aid funds of the Chinese government. To facilitate the reform on foreign aid provision modalities.&lt;/p&gt; &lt;p&gt;12. To formulate and implement economic and trade policies as well as mid-term and long-term trade planning for the Hong Kong Special Administrative Region (HK SAR), Macao Special Administrative Region (Macao SAR) and Taiwan region. To hold economic and trade talks with the competent authorities in charge of trade and economic affairs of HK SAR and Macao SAR as well as authorized non-governmental organizations of Taiwan and sign the relevant documents. To be in charge of the commercial and trade liaison mechanism between the mainland and the HK SAR and Macao SAR. To organize the direct trading activities with Taiwan, and to be responsible for bilateral and multilateral trade issues involving Taiwan.&lt;/p&gt; &lt;p&gt;13. To be responsible for the training, selection and management of Chinese professionals working in the Permanent Mission of the People's Republic of China To the World Trade Organization, the Economic and Commercial Counselor’s Offices of the Chinese Embassies and missions to other international organizations.
